The Council, according to order, resolved itself into a Committee of the Whole for the further consideration of the Industrial Law Reform (Enterprise and Economic Development - Labour Market Relations) Bill.

                                   Clause No. 55, which the Minister for Industry and Trade had moved to amend on page 34, after line 18, by inserting new paragraph as follows:

                                   “(da) whether the employer has failed to comply with an obligation under section 58B or 58C of the Workers Rehabilitation and Compensation Act 1986; and”

                          and on page 34, lines 21 to 24, by leaving out subclause (2).

                          And which the Hon. R. D. Lawson had moved to amend on page 34, lines 21 to 24, by leaving out subclause (2) and inserting new subclause as follows:

“(2)   Section 108—after subsection (2) insert:

(2a)   In addition, in deciding whether a dismissal was harsh, unjust or unreasonable, the Commission may have regard to the fact that the WorkCover Corporation of South Australia, or a review authority acting under the Workers Rehabilitation and Compensation Act 1986, has found that the employer has failed to comply with an obligation under section 58B or 58C of the Workers Rehabilitation and Compensation Act 1986 (if relevant).”.

 “(6)     If there is a dispute as to whether or not there is a member of a particular association employed at a particular workplace, an official of the association may refer the dispute to the Commission and the Commission may determine the matter.

   (7)     The Commission must not, in acting under subsection (6), disclose the identity of a relevant member of an association to the employer.”.

as at the immediately preceding 30 June.

(2)     Section 141—after subsection (3) insert:

(3a)      A person is entitled to inspect (without charge) a copy of any information provided under subsection (3) during ordinary business hours at the office of the Registrar.”.

                          The Hon. N. Xenophon moved to amend the amendment in subclause (1) by leaving out proposed new subparagraph (ii).
