After Schedule 6 insert:

1—Horticultural netting
(1) The construction or alteration of, or addition to, a protective tree netting
structure on a site if—
(a) no part of the protective tree netting structure will be more than
6 m above ground level (depending on where it is situated); and
(b) netting visible from the outside of the protective tree netting
structure is of a low light-reflective nature, and, in the case of a
structure that has side netting, the side netting is of a dark colour;
and

1—Interpretation
In this Schedule—
construction activity includes—
(a) demolition work, site preparation work and building maintenance or repair
work; and
(b) the operation of vehicles within, or entering or leaving, a construction site;
and
(c) any activities, at or within the immediate vicinity of a construction site, of
persons who perform work at the site, or work connected with work at the
site;
public infrastructure means—
(a) infrastructure, equipment, structures, works and other facilities used in or in
connection with the provision of essential services or telecommunications;
and
(b) roads and their supporting works;
public infrastructure works means works for the construction, installation, repair,
maintenance
